KOCHI CORPORATION COLLECTS PARKING FEE - POLICE COLLECTS VEHICHLE WITH RECOVERY VAN!

The Kochi corporation planted a parking board and parking rates on the side of Banerjee Road near High Court for several years. All of a sudden, the Kochi City Traffic Police threatened of collecting the vehicle using recovery van, bcs they declared the road as No parking. The SOCIAL JUSTICE WATCH enquired about the issue. Whether the police gone through the procedure for making a road as no parking road? see the answer-

Your attention is invited to the subject cited.
1 Whether any steps have been taken by the Kochi City Traffic to change the parking area marked by the Corporation of Cochin on the Southern side of Banerjee Road (from High Court Bus stop Jn. to Basin Road Junction) to No-Parking area ?
Kochi City Traffic Police has not received any intimation from Corporation of Cochin declaring any side of Banerjee Road from High Court bus stop Jn to Banerjee Road a parking area. The road from High Court bus stop Jn to Basin Road Jn is a very important road in its very nature. The exist from Hon’ble High Court of Kerala has to be made absolutely non-congested and enhanced free flow in the wake of many terrorist influence in Kerala. This is a matter of utmost security importance and may please be communicated among other staff.
2 Whether ay consultation with the District Magistrate had been made as per the provisions of section 18 of Kerala Police Act 1960 for making traffic regulations for parking in the above said area in Banerjee Road? Whether any sanction of the Government has been secured for the above said regulation in traffic?
The Hon’ble High Court of Kerala while disposing the MFA No: 66/2003 gave certain directions to the State Government. While examining the directions, the State Government has put forth certain suggestions vide letter No: 12424/d3/2008/trans. The government has directed police and concerned departments to remove and fine parking of vehicles on important roads. It is statutory that vehicle cannot be allowed to park on roads since parking of vehicles on roads is prohibited by rule.
More over, Under the provision of 29(m) of KP Act “it shall be the duty of every police officer- to regulate and control the traffic in the streets to prevent obstructions there in and to the best of his ability prevent the infraction of any rule or order made under this Act or under any other law for the time being in force for observance by the public in or near the streets.
3 Whether any sanction has been secured from Government or from any other authorities for placing ‘cones’ in the middle of the Banerjee road or making medians in the middle of the road without any widening of the existing road?
Kochi City roads follow two-way traffic system. In an hour minimum 6,000 vehicles pass by a Jn. Being traffic regulatory authority we have to accommodate and enhance free flow of vehicles without reporting any sort of accident. As there is no traffic median, many drivers try to take advantage of the other side of the road disregarding the need of other person, consequently create traffic jam. The duties like construction of road median, Zebra crossing etc vest upon PWD/ Cochin Corporation. Unless and until road median are not constructed, illuminated cones are invertible to bring a lane discipline among drivers. The matter was placed before the road safety council headed by District Collector held on 22.09.2009 at District Collectorate and Rs 3 Lakhs were allotted to purchase traffic Cones.
